Supreme Court of India: SLPs, Transfer Petitions and Writs

The Supreme Court is the final court of appeal in India. Most cases reach it through a Special Leave Petition. Here is how the process works.

Special Leave Petition (SLP)

Under Art. 136, the Supreme Court may grant special leave to appeal against any judgment or order of any court or tribunal in India (except military tribunals). It is a discretionary remedy, generally exercised where there is a substantial question of law or grave injustice.

  • Time limit: 90 days from the date of the High Court's judgment, or 60 days from the order refusing a certificate of fitness to appeal. Delay can be condoned with sufficient explanation.
  • Contents: synopsis and list of dates, questions of law, grounds, certified copy of the impugned judgment, annexures, affidavit and, if needed, an application for interim relief or condonation of delay.
  • Filing: Petitions are filed through an Advocate-on-Record of the Supreme Court.

What Happens After Filing

  1. The petition is listed for admission before a Bench.
  2. The Court may dismiss it at the threshold, or issue notice to the other side, often with interim relief such as a stay.
  3. If leave is granted, the SLP is converted into a civil or criminal appeal and heard on merits.

What is the time limit for filing an SLP in the Supreme Court?

An SLP must generally be filed within 90 days from the date of the High Court's judgment, or within 60 days from the date of an order refusing a certificate of fitness to appeal. Delay may be condoned for sufficient cause.

Can a matrimonial case be transferred to another state?

Yes. The Supreme Court can transfer a civil case, such as a divorce petition, from one state to another under Section 25 of the CPC. Courts generally consider the convenience of the wife in matrimonial transfer petitions.

Is every SLP heard by the Supreme Court?

No. Special leave is discretionary. Many SLPs are dismissed at the admission stage. If the Court finds merit, it issues notice to the other side and may later grant leave and hear the appeal.
