How to File a Consumer Complaint

Steps

  1. Complain to the seller or service provider in writing, and try the National Consumer Helpline (1915) for a quick resolution.
  2. Send a legal notice if the issue is not resolved.
  3. File the complaint online on the government's e-filing portal (e-Jagriti, which replaced e-Daakhil) or at the Commission, with bills, warranty cards, correspondence and proof of payment.
  4. No fee is payable for claims up to ₹5 lakh; a small fee applies above that.
  5. The Commission may refer the matter to mediation; otherwise it decides on the documents and affidavits.

What is the time limit to file a consumer complaint?

A complaint must be filed within 2 years from the date on which the cause of action arose, under Section 69 of the Consumer Protection Act, 2019. Delay can be condoned for sufficient cause.

Can I file a consumer complaint online?

Yes. Consumer complaints can be filed online through the government's e-Jagriti portal, which replaced e-Daakhil, and hearings may also be held by video conference.

Do I need a lawyer for a consumer complaint?

No, a consumer can file and argue the complaint personally. A lawyer helps in drafting, presenting evidence and handling complex cases such as builder, insurance or medical negligence disputes.
