When can a case be taken to the Supreme Court of India?

A judgment or order of a High Court, tribunal (such as the NCLAT or DRAT) or other authority can be challenged before the Supreme Court, usually through a Special Leave Petition (SLP) under Article 136. The Supreme Court also hears writ petitions for violation of fundamental rights under Article 32, transfer petitions (often in matrimonial cases) and statutory appeals. Strict limitation periods apply, typically 90 days for an SLP.

What is the DRT and when should I approach a DRT lawyer?

The Debt Recovery Tribunal (DRT) decides recovery applications filed by banks and financial institutions for dues of ₹20 lakh and above, and hears borrowers' Securitisation Applications against SARFAESI action such as possession or auction notices. Borrowers and lenders should seek legal advice as soon as a demand or Section 13(2) notice is received, as statutory time limits apply.

What matters does the NCLT handle?

The National Company Law Tribunal hears insolvency petitions under the Insolvency and Bankruptcy Code (Sections 7, 9 and 10), oppression and mismanagement petitions, mergers and amalgamations, and other matters under the Companies Act, 2013.

How do I report a cyber crime or online fraud?

Report online financial fraud immediately on the national helpline 1930 and on cybercrime.gov.in, and inform your bank to freeze the transaction. Preserve screenshots, messages and transaction IDs. A lawyer can help with the complaint, follow-up with the police and recovery of funds.

How long does a mutual consent divorce take?

Under Section 13B of the Hindu Marriage Act, a mutual consent divorce involves two motions with a statutory cooling period of six months, which the court may waive in suitable cases. The overall time depends on the facts and the court.

What should I do if a cheque given to me bounces?

Under Section 138 of the Negotiable Instruments Act, a legal demand notice must be sent within 30 days of receiving the bank's return memo. If payment is not made within 15 days of the notice, a complaint can be filed within the following one month.
