Received a SARFAESI Notice? Borrower Rights and Remedies

SARFAESI allows banks to take possession of and sell secured property without going to court. Borrowers have specific rights at each stage — but strict deadlines apply.

When SARFAESI Does Not Apply

  • Agricultural land
  • Loans below ₹1 lakh, or where the outstanding is less than 20% of principal and interest
  • Loan accounts not properly classified as NPA

Common Grounds of Challenge

  • Improper NPA classification or wrong amount demanded
  • Defective notice, or failure to consider the borrower's objection
  • Undervaluation of the property, or improper auction procedure
  • Possession of property not covered by the security

Practical Steps

  1. Never ignore the 13(2) notice. Note the date of receipt.
  2. Send a written objection or representation under 13(3A) within the 60 days.
  3. Explore restructuring or one-time settlement early, in writing.
  4. If possession is taken, file the Securitisation Application in the DRT within 45 days.
  5. Appeal from the DRT to the DRAT requires a pre-deposit of 50% of the amount, which may be reduced to 25% SARFAESI 18.

Frequently Asked Questions

How many days does a borrower get after a SARFAESI 13(2) notice?

The borrower gets 60 days from the date of the notice to repay the outstanding amount. During this period, the borrower can also send an objection under Section 13(3A), which the bank must answer within 15 days.

How can I stop a bank auction under SARFAESI?

A borrower can redeem the property by paying the full dues with costs before the publication of the auction notice under Section 13(8). The auction can also be challenged before the DRT through a Securitisation Application if the procedure was not followed.

What is the time limit to file a Securitisation Application in DRT?

45 days from the date on which the measure under Section 13(4), such as taking possession, was taken.

Can SARFAESI be used against agricultural land?

No. Section 31 of the SARFAESI Act excludes security interest created on agricultural land.
